Terms & Conditions
Last updated: 3/09/2026
These Terms & Conditions govern the use of the Motive Manufacturing website and the purchase of 3D printing and custom CAD/design services.
Motive Manufacturing is operated by Cohen Michael Green, an Australian sole trader trading under the business name Motive Innovations (ABN: 59 449 145 565).
By using this website, submitting a quote request, uploading a file, accepting a quote, or purchasing our products or services, you agree to these Terms & Conditions.
If you do not agree with these Terms & Conditions, you should not use our services.
1. Services
Motive Manufacturing provides services including:
- 3D printing of customer-supplied digital files;
- custom CAD and 3D design services; and
- related design and manufacturing services agreed between Motive Manufacturing and the customer.
Services are provided according to the specifications contained in the customer's accepted quote and any subsequent written agreement between the parties.
2. Quotes
Customers may submit files and project information through our online quote system.
A quote provided by Motive Manufacturing is an estimate of the price for the requested work and is subject to the information and files supplied by the customer.
Unless otherwise stated, a quote does not constitute acceptance of an order.
An order is accepted when the customer accepts the quote and successfully completes payment through the payment method provided by Motive Manufacturing.
Motive Manufacturing may contact the customer before accepting an order if clarification or additional information is required.
If the information supplied by the customer is materially incomplete or inaccurate, Motive Manufacturing may need to provide a revised quote before proceeding with the work.
3. Customer-Supplied Files and Intellectual Property
3.1 Customer responsibility
When a customer uploads, submits or otherwise provides a file, design, model, image or other material to Motive Manufacturing, the customer represents and warrants that:
- they own the relevant rights in the material; or
- they have obtained all permissions, licences and authorisations necessary to have the material reproduced, manufactured or otherwise used for the requested service.
The customer is responsible for determining whether any licence or other restriction applies to a submitted file.
This includes restrictions relating to:
- copyright;
- commercial use;
- manufacturing;
- reproduction;
- distribution;
- patents;
- registered designs;
- trade marks; and
- other intellectual property rights.
The customer must not submit a file for manufacture where they do not have the necessary rights or permissions to authorise that manufacture.
3.2 Authorisation to manufacture
By submitting a file for 3D printing, the customer authorises Motive Manufacturing to reproduce the file as reasonably necessary to provide the requested manufacturing service.
This permission is limited to fulfilling the customer's order and does not transfer ownership of the customer's intellectual property to Motive Manufacturing.
3.3 Third-party files
If a customer obtains a file from a third party, online repository, designer or other source, the customer is responsible for checking the applicable licence and obtaining any necessary permission before submitting the file.
For example, a file that permits personal use but prohibits commercial use must not be submitted to Motive Manufacturing for manufacture unless the customer has obtained appropriate permission from the rights holder.
3.4 Intellectual property claims
The customer is responsible for claims arising from the customer's failure to have the necessary rights or permissions to submit a file for manufacture.
The customer agrees to reasonably cooperate with Motive Manufacturing in responding to any claim relating to a customer-supplied file.
Nothing in these Terms & Conditions limits any liability that cannot legally be limited under Australian law.
3.5 Suspected infringement
Motive Manufacturing may refuse or pause an order if we reasonably believe that:
- the customer may not have the necessary rights or permissions;
- the submitted material may infringe a third party's rights;
- the requested manufacture may be unlawful; or
- additional information or permission is reasonably required.
Where appropriate, Motive Manufacturing may request evidence of the customer's permission or licence before proceeding.
4. Customer Files and File Deletion
Motive Manufacturing generally retains customer-uploaded files only for as long as reasonably necessary to assess, quote and manufacture the customer's order.
After production has been completed, customer files will generally be deleted from our active production systems.
Where a customer specifically asks Motive Manufacturing to retain a design for future reproduction, we may retain the relevant file for that purpose.
A customer may request deletion of a retained file at any time, subject to any legal or legitimate business requirement to retain information.
Further information about handling of personal information and files is contained in our Privacy Policy.
5. Custom CAD and Design Services
Where Motive Manufacturing creates a custom CAD design for a customer, ownership of the completed custom design will transfer to the customer once the agreed design service has been fully paid for, unless otherwise agreed in writing.
Unless otherwise agreed, Motive Manufacturing retains ownership of:
- its pre-existing designs, templates, libraries, techniques and processes;
- general know-how and skills used to create the design; and
- materials or components that were not specifically created for the customer's project.
Where a customer requests revisions beyond the scope of the original quote, additional charges may apply.
The final deliverable supplied to the customer will be the file format or formats specified in the accepted quote.
Motive Manufacturing may retain a copy of a completed CAD design where the customer has expressly requested or authorised retention for future reproduction.
6. Manufacturing and 3D Printing
3D printing is a manufacturing process and minor variations may occur between the digital model and the finished physical item.
Depending on the material, geometry, print orientation and manufacturing process, products may exhibit minor characteristics such as:
- layer lines;
- minor surface imperfections;
- support marks;
- dimensional variations within reasonable manufacturing tolerances; or
- variations in colour or finish.
Motive Manufacturing will make reasonable efforts to produce the item in accordance with the accepted quote and supplied specifications.
Where a particular dimensional tolerance, surface finish, strength requirement or other technical specification is important, the customer should communicate that requirement before accepting the quote.
7. Customer-Provided Specifications
The customer is responsible for providing accurate information, dimensions and requirements necessary for the requested service.
If the customer provides an incorrect file, dimension, specification or other instruction, Motive Manufacturing is not responsible for problems arising solely from that incorrect information.
Where Motive Manufacturing identifies an apparent issue with a supplied file or specification, we may contact the customer before proceeding.
8. Prohibited or Refused Orders
Motive Manufacturing may refuse to manufacture a file or provide a service where we reasonably believe that the requested work:
- may be unlawful;
- may infringe third-party intellectual property rights;
- involves material for which the customer cannot demonstrate appropriate rights or permission;
- presents an unreasonable safety risk;
- is inconsistent with our business policies; or
- cannot reasonably be produced using our available equipment or processes.
If an order is refused before manufacturing begins, Motive Manufacturing will generally refund amounts paid for the refused order, subject to any applicable rights under Australian law.
9. Payment
Payment must be made using the payment method made available during checkout.
Payments are processed through third-party payment providers. Motive Manufacturing does not generally receive or store customers' complete payment card details.
Prices are stated in Australian dollars unless otherwise specified.
Any applicable GST will be handled in accordance with Australian taxation law.
An order will generally not enter production until payment has been successfully received.
10. Cancellations
A customer may request cancellation of an order before manufacturing has commenced.
Once manufacturing has commenced, the order generally cannot be cancelled simply because the customer has changed their mind.
However, nothing in these Terms & Conditions excludes, restricts or modifies any rights the customer has under the Australian Consumer Law or other applicable law.
Where cancellation is requested after manufacturing has commenced, Motive Manufacturing may consider the circumstances and any applicable legal rights before determining whether a refund is available.
11. Consumer Guarantees
Motive Manufacturing recognises and complies with the consumer guarantees that apply under the Australian Consumer Law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right or remedy that cannot legally be excluded, restricted or modified.
Mandatory Australian Consumer Law Notice
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
• to cancel your service contract with us; and
• to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your service contract and obtain a refund for the unused portion.
You are also entitled to choose a refund or replacement for major failures with goods.
These rights operate independently of any voluntary policies or warranties offered by Motive Manufacturing.
12. Refunds and Remedies
If a product or service does not meet an applicable consumer guarantee, Motive Manufacturing will provide the remedy required by law.
Depending on the circumstances, this may include repair, replacement, refund, cancellation or compensation.
Where a customer simply changes their mind after purchasing a product, no general change-of-mind refund is provided unless Motive Manufacturing agrees otherwise.
This does not affect any rights the customer has under the Australian Consumer Law.
13. Shipping
Motive Manufacturing currently ships orders within Australia.
Shipping costs will be displayed or included in the customer's accepted quote.
Customers are responsible for providing an accurate delivery address.
Motive Manufacturing is not responsible for delays caused by incorrect addresses supplied by the customer or events outside our reasonable control.
If an item is lost or damaged during delivery, Motive Manufacturing will work with the customer and the relevant delivery provider to resolve the issue, subject to the customer's rights under Australian law.
14. Delivery Estimates
Any estimated production or delivery timeframe provided by Motive Manufacturing is an estimate unless expressly stated otherwise.
Delays may occur due to:
- equipment failure;
- material availability;
- supplier or courier delays;
- unusually high order volumes;
- customer-requested changes; or
- events outside our reasonable control.
Motive Manufacturing will make reasonable efforts to communicate material delays.
Nothing in this clause limits a customer's rights where the law provides a remedy for failure to supply within a reasonable time.
15. Customer Accounts
Customers may create an account to access available website functionality.
Customers are responsible for maintaining the confidentiality of their account credentials and for activity carried out through their account.
Customers may also be able to obtain quotes or place orders as guests where this functionality is available.
Motive Manufacturing may suspend or terminate an account where reasonably necessary to protect the website, our customers or our business.
16. Website Availability
We aim to keep the Motive Manufacturing website available and functional but do not guarantee uninterrupted or error-free operation.
Website functionality may occasionally be unavailable due to maintenance, technical issues, updates or circumstances outside our reasonable control.
17. Third-Party Services
Motive Manufacturing uses third-party services to operate parts of its website and payment process, including:
- Base44, which provides website/application infrastructure; and
- Stripe, which processes payments.
Use of these services may be subject to the relevant third party's own terms and privacy policies.
Motive Manufacturing is not responsible for interruptions or failures caused solely by third-party services, subject to any rights or obligations that cannot legally be excluded.
18. Intellectual Property in the Motive Manufacturing Website
Unless otherwise stated, the content and materials created by Motive Manufacturing for its website and business, including branding, text, graphics and original website content, remain the property of Motive Manufacturing or the relevant rights holder.
Customers must not reproduce or commercially exploit these materials without appropriate permission.
19. Limitation of Liability
To the maximum extent permitted by law, Motive Manufacturing' liability arising from a particular service will be limited to the remedies available under applicable law.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.
In particular, these Terms & Conditions do not exclude or limit rights arising under the Australian Consumer Law.
20. Indemnity
To the extent permitted by law, a customer agrees to compensate Motive Manufacturing for reasonable loss or costs arising directly from the customer's breach of these Terms & Conditions, including the customer's failure to have the necessary rights or permissions to submit a third-party file for manufacture.
This clause does not apply to the extent that the relevant loss was caused by Motive Manufacturing' own breach, negligence or unlawful conduct.
Nothing in this clause excludes or limits any liability that cannot legally be excluded or limited.
21. Events Outside Our Control
Motive Manufacturing will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including significant equipment failure, supply interruptions, natural disasters, power outages, telecommunications failures or courier disruptions.
This clause does not remove any rights the customer may have under applicable consumer law.
22. Privacy
Motive Manufacturing collects and handles personal information in accordance with our Privacy Policy.
By using our services, customers acknowledge that personal information may be collected and used for purposes including processing quotes and orders, communicating with customers, delivering products and providing customer support.
Our Privacy Policy explains how information is handled and how customers can contact us regarding their personal information.
23. Marketing Communications
Where a customer has provided consent to receive marketing communications, Motive Manufacturing may send information about products, services, promotions, updates and other business communications.
Customers can unsubscribe from marketing communications at any time using the unsubscribe mechanism provided in the relevant communication.
Unsubscribing from marketing communications will not prevent Motive Manufacturing from sending necessary transactional or service-related communications.
24. Changes to These Terms
Motive Manufacturing may update these Terms & Conditions from time to time.
The version applicable to an order will generally be the version presented to and accepted by the customer at the time the order is placed.
Changes will not retrospectively remove rights that have already arisen under applicable law.
25. Governing Law
These Terms & Conditions are governed by the laws of South Australia and applicable Commonwealth laws of Australia.
Any dispute will be subject to the applicable courts and tribunals of South Australia, subject to any mandatory rights or jurisdiction provided by law.
